I never believed for a moment that this man was guilty. He had the massive support from his wife and family but not from the wider community who had no idea of the full circumstances of this tragedy. He was charged with murder and manslaughter of his six week old child by allegedly applying some unknown form of force/trauma and went to trial.
We knew there was an alternative cause of the child's death, not trauma. and we commenced our investigation to find the cause. We found his child died of natural medical causes as we formulated through our own expert witnesses which we gathered from the USA & Canada, professors & assoc professors in various fields of expertise.
In 2017 he was convicted of manslaughter but not guilty of murder. We successfully appealed to the Queensland Court of Appeal and were given a retrial. The Queensland DPP went to the High Court and were unsuccessful. The retrial was heard this year and he was found not guilty of manslaughter. Because of the overwhelming complexity provided by the medical experts and its importance in legal precedents, an invitation was given by the Queensland Law Society to our Legal team for a paper to be given on the subject recently on the Gold Coast.
An innocent man can now resume his life with his wife and properly mourn the loss of his son.
